These terms govern your use of capeklaw.com. They explain what you may do with the material on this site, what we do and do not promise, and the legal ground rules that apply between you and Capek Law, P.C. By using the site, you agree to them.

    These Terms & Conditions are an agreement between you and Capek Law, P.C. (“Capek Law,” “the firm,” “we,” “us”). They apply every time you visit capeklaw.com, read a page, submit a form, or otherwise interact with the site.

    If you do not agree with any part of these terms, please do not use the site. Your continued use is your acceptance of the version of these terms posted at that time.

  2. Who May Use This Site

    This site is intended for adults who are at least 18 years old and are located in the United States. It is directed primarily to people in Pennsylvania, New Jersey, and Delaware, and nothing here is an offer to practice law in any jurisdiction where the firm is not licensed to do so.

    If you are a minor, please ask a parent or guardian to contact us on your behalf.

  3. No Legal Advice

    Everything on this site is general information published for educational purposes. It is not legal advice, it is not tailored to your situation, and it should never be used as a substitute for a consultation with a licensed attorney.

  4. No Attorney–Client Relationship

    Using this site, reading our content, or sending us a message through a form, email address, or phone number listed here does not create an attorney–client relationship between you and Capek Law, P.C.

    We represent a client only after we have checked for conflicts of interest, agreed to take the matter, and both parties have signed a written fee agreement. Until that happens, we are not your lawyers and we are not acting to protect your interests or preserve your deadlines.

  5. Do Not Send Confidential Information

    Please do not send us confidential, sensitive, or time-critical details about your case through this website, email, or text message until we have confirmed in writing that we represent you.

    Information you send before an attorney–client relationship exists may not be protected by the attorney–client privilege, may not be treated as confidential, and will not prevent us from representing another party in the same matter. Share only what is needed for us to identify you and understand, at a high level, what your matter involves.

  6. Attorney Advertising

    Portions of this website may be considered attorney advertising under the rules of professional conduct in Pennsylvania, New Jersey, Delaware, or other jurisdictions. It is offered for informational purposes and is not a solicitation for business in any state where the firm is not admitted to practice.

    If you believe material on this site infringes your copyright, please contact us with a description of the work, the location of the material, and your contact information so we can review it.

  10. Submissions & Feedback

    If you send us comments, suggestions, testimonials, or other feedback about the site or the firm, you grant us a non-exclusive, royalty-free, perpetual right to use and publish that material for any lawful purpose, without payment or attribution, unless we agree otherwise in writing.

    Where liability cannot be excluded, our total liability relating to the site is limited to one hundred dollars ($100). Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here alters the professional obligations we owe to actual clients of the firm.

    You agree to indemnify and hold harmless Capek Law, P.C. and its attorneys, employees, and agents from any claim, loss, liability, or expense — including reasonable attorneys’ fees — arising out of your misuse of this site, your violation of these terms, or your violation of any law or the rights of a third party.

    You agree that the state and federal courts located in Philadelphia County, Pennsylvania have exclusive jurisdiction over any such dispute, and you consent to venue in those courts.

  22. Resolving Disputes

    If you have a concern about this website or about the firm, we ask that you contact us first so we have the chance to address it directly. Most issues are resolved this way.

    If a dispute cannot be resolved informally, either party may pursue it in the courts identified above. Disputes between the firm and an existing client about legal services are governed by the written fee agreement between us and by the applicable rules of professional conduct, including any fee dispute resolution program offered by the relevant bar association.

  23. General Terms

    If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.

    You may not assign your rights under these terms; we may assign ours in connection with a merger, reorganization, or transfer of the firm’s practice. These terms, together with our Privacy Policy and Legal Disclaimer, are the entire agreement between you and the firm regarding your use of this site.

  24. Changes to These Terms

    We may update these terms as our site, our services, or the law changes. The revised version takes effect when it is posted, and the “last updated” date above will tell you when that was.

    Please review this page periodically. Continuing to use the site after a change means you accept the updated terms.
